1. ACCEPTANCE OF TERMS
These Terms of Service (“Terms”) govern your use of the Tap In application, website, and Services. By accessing or using Tap In, you agree to be bound by these Terms. If you do not agree, you must not use the Services.
2. ELIGIBILITY
You must be at least 13 years old to use Tap In. If you are under 18, you must have permission from a parent or legal guardian to use the Services. By using Tap In, you represent and warrant that you meet these requirements.
3. ACCOUNT REGISTRATION AND SECURITY
To use certain features of Tap In, you must create an account. You agree to:
-Provide accurate, current, and complete information
-Maintain and promptly update your information as needed
-Keep your password and login credentials secure
-Not share your account or credentials with others
You are responsible for all activities that occur under your account. Tap In reserves the right to suspend or terminate your account if we suspect any violation of these Terms or misuse of the Services.
4. DESCRIPTION OF THE SERVICES AND GENERAL DISCLAIMER
Tap In is an app designed to support Brazilian Jiu-Jitsu practitioners and gyms by providing:
-Gym and class information
-Training logs, notes, and goals tracking
-Tools to organize and view training activity
-User-submitted gym reviews and ratings
Tap In is not a gym, training facility, coaching service, medical provider, or safety authority. We do not supervise or monitor training sessions, gym environments, instructor qualifications, or the safety of any physical activity.
All gym listings, schedules, reviews, and related information are provided for informational and organizational purposes only and may not always be accurate or up to date.
5. USE OF GEO-LOCATION FOR TRAINING INSIGHTS
To provide accurate training insights and attendance information to users and gyms, Tap In may use your device’s geo-location data to detect when you are present at a participating Brazilian Jiu-Jitsu gym. By using the Services, you consent to this use of location data for:
-Identifying visits to BJJ gyms
-Verifying training sessions and frequency
-Generating training and attendance metrics for you
-Providing aggregated or de-identified analytics to gyms
Tap In will not share your precise location with any gym other than your designated home gym and will not share your location with third parties for unrelated marketing or sales purposes. Any location-based insights provided to gyms are aggregated, de-identified, or restricted to your home gym, unless otherwise authorized by you.
You may disable location services at any time in your device settings, but doing so may limit or disable certain features of the Services.
6. PAYMENTS AND SUBSCRIPTIONS
Tap In may offer paid subscriptions, premium features, or facilitate payments between gym members and gyms. By making a purchase or authorizing a payment, you agree to:
-Provide accurate payment information
-Authorize us and our payment processors to charge your selected payment method for the applicable amounts
Subscriptions may renew automatically at the end of each billing cycle unless you cancel before the renewal date. It is your responsibility to manage your subscription and cancellation settings.
Except where required by law, all sales are final and non-refundable.
7. USER CONTENT AND GYM REVIEWS
You may submit content to Tap In, including gym reviews, ratings, comments, photos, and other materials (“User Content”). You retain ownership of your User Content, but by submitting it, you grant Tap In a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, distribute, display, and perform that content in connection with operating and improving the Services.
You agree that your User Content will:
-Be truthful and based on your actual experiences
-Not be defamatory, hateful, harassing, or otherwise unlawful
-Not infringe any third party’s intellectual property or privacy rights
Tap In may, but is not obligated to, review, remove, or limit access to any User Content at our sole discretion.
Gyms may not offer compensation or incentives in exchange for positive reviews, and users may not sell or trade reviews.
8. PROHIBITED USES
You agree not to:
-Use the Services for any unlawful purpose
-Harass, threaten, or harm others
-Attempt to gain unauthorized access to the Services or related systems
-Interfere with or disrupt the operation of the Services
-Use any automated means (such as bots or scrapers) to access the Services without our permission
-Misrepresent your identity or affiliation
Tap In reserves the right to investigate and take appropriate action, including account suspension or termination, for violations of this section.
9. CONTACT SPORT WARNING AND ASSUMPTION OF RISK
Brazilian Jiu-Jitsu is an inherently risky, full-contact combat sport that may involve grappling, submissions, takedowns, throws, and other movements that can result in serious injury, including but not limited to: strains, sprains, fractures, concussions, spinal injuries, paralysis, or death.
By using Tap In and engaging in any training activities connected in any way to information from the app, you acknowledge and agree that:
-You voluntarily assume all risks associated with Brazilian Jiu-Jitsu and related physical activities.
-Tap In does not supervise, monitor, or control any training sessions, gyms, instructors, or training partners.
-Tap In makes no representations or warranties regarding the safety, cleanliness, or suitability of any gym or training environment.
-You are solely responsible for ensuring that you are medically and physically fit to train and that you consult a medical professional before engaging in strenuous physical activity.
You fully release Tap In LLC, its owners, officers, employees, and partners from any and all claims or liability arising out of injuries, damages, or losses connected to training or use of information obtained through the Services.
10. NO RESPONSIBILITY FOR INJURIES OR TRAINING OUTCOMES
Tap In assumes no responsibility or liability for any:
-Injuries or accidents occurring during training or at gyms
-Injuries resulting from techniques performed, attempted, or learned
-Emotional, psychological, or physical harm related to training activities
-Decisions you make in reliance on information obtained from the app
All training and physical activity are undertaken at your own risk.
11. NO RESPONSIBILITY FOR DATA ACCURACY
Tap In provides gym listings, schedules, instructor information, and class data that may be provided by gyms, users, or third parties. This information may be inaccurate, outdated, or incomplete.
Tap In does not guarantee the accuracy, reliability, or completeness of any such information. We assume no responsibility or liability for:
-Incorrect or outdated class times or schedules
-Gym closures, cancellations, or changes
-Incorrect or misleading gym or instructor profiles
-Errors or omissions in any data or content displayed in the app
You are responsible for independently verifying any important information with the relevant gym or provider.
12. GENERAL DISCLAIMER OF WARRANTIES
The Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied. To the fullest extent permitted by law, Tap In disclaims all warranties, express or implied, including but not limited to:
-Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
-Any warranties regarding accuracy, reliability, or availability of the Services
Tap In does not warrant that the Services will be uninterrupted, secure, or error-free.
13. LIMITATION OF LIABILITY
To the maximum extent permitted by law, in no event will Tap In LLC, its officers, employees, or partners be liable for any:
-Indirect, incidental, consequential, special, punitive, or exemplary damages
-Loss of profits, data, goodwill, or other intangible losses
This includes, without limitation, any damages resulting from:
-Your access to or use of, or inability to access or use, the Services
-Any conduct or content of any third party, including gyms, instructors, or other users
-Any content or information obtained from the Services (including inaccurate data or gym/class information)
-Unauthorized access, use, or alteration of your transmissions or content
In any case, Tap In’s total liability for all claims arising out of or relating to the Services will not exceed the total amount you paid to Tap In in the twelve (12) months preceding the claim, if any.
Some jurisdictions do not allow the exclusion or limitation of certain damages; in such cases, our liability will be limited to the maximum extent permitted by law.
14. BINDING ARBITRATION AND CLASS ACTION WAIVER
14.1 Agreement to Arbitrate
You and Tap In agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services will be resolved by binding arbitration, rather than in court, except as otherwise provided in this section.
14.2 Class Action WaiverYou agree that any arbitration or legal proceeding will be conducted only on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in a class action against Tap In.
14.3 Exceptions
Either party may:
-Bring an individual action in small claims court; or
-Seek injunctive or other equitable relief in a court of competent jurisdiction to prevent or stop infringement, misappropriation, or violation of intellectual property rights.
15. TERMINATION
Tap In may suspend or terminate your access to the Services at any time, with or without cause or notice, including if we reasonably believe you have violated these Terms or misused the Services.You may stop using the Services and/or delete your account at any time. Certain provisions of these Terms, including those relating to intellectual property, disclaimers, limitations of liability, and dispute resolution, will survive termination.
16. GOVERNING LAW
These Terms and any disputes arising out of or related to them will be governed by the laws of the State of Illinois, without regard to its conflict of laws principles, except where otherwise required by applicable law.
17. CHANGES TO THESE TERMS
We may modify these Terms from time to time. When we do, we will update the “Effective Date” at the top of this document. In some cases, we may notify you via email or in-app notification. Your continued use of the Services after any changes to the Terms constitutes your acceptance of the revised Terms.
